Terms of Service

1. About Us

Malek365 ("the Service", "the Platform") is a software-as-a-service property management platform owned and operated by Mosaic Elite (شركة موزايك إيليت), a Simplified Joint-Stock Company (شركة مساهمة مبسطة شخص واحد) registered in the Kingdom of Saudi Arabia.

References below to "we", "us", or "our" mean Mosaic Elite. References to "you" or "the Subscriber" mean the organization or individual subscribing to the Service.

2. Acceptance of Terms

By subscribing to or using Malek365, you agree to these Terms. If you do not agree, you may not use the Service.

3. The Service

Malek365 helps property owners and operators manage lease contracts, track payments, organize tenant records, and generate reports. The full feature set available to a Subscriber depends on the subscription plan in effect.

We may update, improve, or modify features over time. We will give reasonable advance notice of any change that materially reduces functionality on a plan you are paying for.

4. Subscription, Pricing, and Payment

  • All published prices are in Saudi Riyals (SAR) and exclude VAT.
  • VAT is added to invoices at the prevailing rate (currently 15%) in accordance with ZATCA regulations.
  • Subscriptions are billed annually and paid via bank wire transfer. The Service is activated for the Subscriber once payment is confirmed.
  • Subscription fees are non-refundable except where required by Saudi law.
  • Subscribers may upgrade their plan at any time; the difference is pro-rated against the remaining term.
  • We may revise pricing at any time. Price changes apply at the next renewal, never mid-term.

5. Subscriber Responsibilities

You agree to:

  • Provide accurate registration and billing information.
  • Keep your account credentials confidential and not share them outside your authorized users.
  • Use the Service only for lawful purposes and in compliance with applicable Saudi laws and regulations.
  • Not attempt to reverse-engineer, copy, or exploit the Service for competitive purposes.
  • Ensure that any tenant or third-party data you upload to the Service has been collected lawfully and that you have the right to process it.

6. Acceptable Use

You may not use Malek365 to:

  • Store or transmit unlawful, fraudulent, defamatory, or infringing content.
  • Send unsolicited communications outside the legitimate landlord-tenant relationship documented in your account.
  • Attempt to disrupt, overload, or compromise the Service or other users' data.

We may suspend or terminate accounts that violate these conditions, with notice where reasonably practicable.

7. Free Trial

We may offer a limited free trial. Trials are for evaluation only and may be ended or modified at our discretion. Data created during a trial that does not convert to a paid subscription may be deleted after the trial ends.

8. Suspension and Termination

We may suspend or terminate your access to the Service if:

  • Subscription fees remain unpaid past the agreed term.
  • You materially breach these Terms.
  • Continued provision is prohibited by law or regulatory requirement.

Upon termination, you may export your data within 30 days. After that period, we may delete it in accordance with our retention policy.

You may cancel your subscription at any time; cancellation takes effect at the end of the paid term.

9. Intellectual Property

The Service, its software, design, and content remain the exclusive property of Mosaic Elite. You retain ownership of your data; we receive only the limited rights described in our Privacy Policy and Data Processing section.

10. Limitation of Liability

To the fullest extent permitted by Saudi law, our total liability under these Terms is limited to the amount you paid us during the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including loss of profits or business opportunity.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any dispute arising from or relating to the Service shall be subject to the exclusive jurisdiction of the competent courts of Jeddah.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to you by email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
